Bill to increase regulations killed in [] state House

"A new bill to increase regulations on lithium mining in South Dakota failed to make it out of the state House on Thursday.

"House Bill 1258, proposed by Rep. Nichole Uhre-Balk, D-Rapid City, would have placed lithium mining under the same regulations as gold and silver rather than its current sand and gravel standards.

"Hard rock mining (gold and silver) is subject to stricter control regulations than sand and gravel mining.

"Organizations like are currently exploring mining operations in the hills. Most lithium in the hills is found around the Granite formation, according to the organization's webpage.

"The South Dakota lithium project is comprised of roughly 23,500 acres of both and private Land.
The House Agriculture and Natural Resources committee first split 6-6 on a do-pass motion Thursday before voting 8-4 to send the bill to the 41st day, killing it.

"''I think the general consensus is that the issue needs to be addressed, and so we'll continue to look harder at that, make sure we get all of our any concerns addressed and try to bring that bill back next year,' Uhre-Balk told the crowd at Saturday's crackerbarrel event hosted by Elevate Rapid City.

"Organizations like the local Indigenous led nonprofit and the spoke out in support of the bill Wednesday, stating that increased lithium mining threatens clean water for Black Hills residents especially since its treated like sand or gravel mining.

"Critics of the bill, such as Mike Lees, program administrator for the Department of Agriculture and Natural Resources Minerals Mining Program, said current regulations are sufficient. At the crackerbarrel, Rep. Tim Goodwin, R-Rapid City, said the bill, 'was going to choke off mining. It was bureaucratic.'

"Uhre-Balk said the bill wouldn't stop mining.

"House Agriculture committee members cited a need to better understand the issue when voting to send it to the 41st day.

The practices employed at the site over the years have added to the harmful of our sacred homeland, the . The health and well being of our citizens is directly linked to the health and well being of the river. Due to industrial and waste management such as forever chemicals, , affecting the river we have not been able to continue our cultural value of being a sustenance fishing people because the fish in the river are not healthy enough for us to consume more than small amounts. This disruption is not just about a food source, it is about the connection to our ancestors and very ways of being suffering due to the oppressive nature of profit over people and the ethos of environmental injustice that places marginalized communities in harm’s way. The expansion of Juniper Ridge under perpetuates harms against the Penobscot Nation, who are the original stewards of these lands and waters dating back over 10,000 years. Coupled with the questionable nature of if this initiative is in line with state statutes, there is no reason to think favorably of it. We add our voice to the assertion that there is no public benefit to this expansion, quite the opposite.” - Penobscot Nation Ambassador , July 16, 2024.

WINDOW ROCK, Ariz. – "Navajo Nation President Buu Nygren today issued an executive order to require an agreement be in place prior to the transport of radioactive material through the Navajo Nation.

"The executive order will be in effect for the next six months.
'This was much needed,' the President said. 'We’re taking this stance of interpreting and executing the law to ensure the safety of our people and respect for Navajo . It’s our job as the executive branch to enforce these laws.'

"Citing the Navajo Nation Natural Resources Protection Act of 2005 and the Navajo Nation’s 2012 Radioactive and Related Substances, Equipment, Vehicles, Persons and Materials Transportation Act, he said Navajo laws regarding the transportation of radioactive materials have been in place for well over a decade.

"'We’re a land of laws,' President Nygren said. 'As the executive branch, as the President of the Navajo Nation, we’re here to enforce these laws to make sure nobody’s breaking these laws.'

"Yesterday, , Inc., owner of the south of Grand Canyon did not provide notice to Navajo Nation officials of the transport of and estimated 50 tons of mine ore through the heart of the Navajo Nation.

WINDOW ROCK, Ariz. – "Navajo Nation President Buu Nygren this morning deployed the Navajo police to attempt to halt the illegal transportation of uranium ore from the Pinyon Plain Mine to the White Mesa Mill in southeastern Utah.
By the end of the day, he received a report that two trucks carrying the uranium ore had reached Utah.

"'What was very disappointing today is that we were under the assumption that we would get 10 days or two weeks heads up if that this was going to happen,' he said. 'Then, at the same time, we were made aware that transportation was not going to happen until October or November.'

"The President said he learned at 11:30 a.m. today that the trucks were en route without notification from , the owner of the Mine, that the transportation of ore was to happen.

"'They snuck through the and they made it onto the Utah side, outside of the reservation,' the President said. 'To me, they operated covertly to travel the Navajo Nation illegally. It’s very disappointing that they did that, that they smuggled uranium across our Nation which is very inappropriate.'

"Navajo Nation Council Speaker Crystalyne Curley expressed the concern of the Council upon hearing the news.
'The Navajo Nation Council strongly condemn today’s action by ,' the Speaker said. 'Our Navajo people have suffered for many years, and many lost their lives due to on our homelands. The Navajo Nation will continue to oppose and fight against the transportation of uranium ore through our lands for the health and safety of our people.'"
